These Terms & Conditions (the "Terms") govern your usage of this website under domain name www.sahseh.co and mobile application (the "Site"). The Site is owned and managed by Sahseh Digital Marketing Company. These Terms apply in full force and effect to your use of this Site and by using this Site, you accept all terms and conditions contained herein and warrant to comply with the Terms. You must not use this Site, if you have any objection to any of these Terms.

This Site is not intended to be used by Minors under the age of 18, Minors under the age of 18 shall be prohibited to register as a user of the Site and are not allowed to transact or use the Site. Except as set forth, individuals not over the age of 18 nor under the age of 13 may register as a user of the Site and benefit from the services of the Site, provided that such users understand and comprehend the Terms and the Privacy Policy.

Any reference to "Sahseh", "We" or "Us" shall mean Sahseh Digital Marketing Company.

Any reference to "You" shall mean the user, visitor and beneficiary of the Site.

Unless the context requires otherwise, any reference to the "Website", "Site" or "App" shall mean the website under domain name www.sahseh.co and mobile application.

Under these Terms, We and/or our licensors own all rights to the intellectual property and material contained in this Site, and all such rights are reserved by law. Your usage of the Site does not grant you any rights or privileges on our intellectual property, you are granted a limited license only, subject to the restrictions provided in these Terms, for purposes of viewing the material contained on this Site solely.

You are expressly and emphatically restricted from all of the following:

1. Selling, sublicensing and/or otherwise commercializing any Site material;
2. Using this Site in any way that is, or may be, damaging to this Site;
3. Using this Site in any way that impacts user access to this Site;
4. Using this Site contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the Site, or to any person or business entity;
5. Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Site, or while using this Site;

Certain areas of this Site are restricted from access by you, and we may further restrict access by you to any areas of this Site, at any time, in its sole and absolute discretion.

In these Terms, the following is applicable if you are permitted by us to display or upload content to the Site and you choose to display or upload Your Content. "Your Content" shall mean any audio, video, text, images or other material you choose to display or upload on this Site or its servers. With respect to Your Content, by displaying or uploading it, you grant us a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not be infringing on any third party’s rights. We reserve the right to remove any of Your Content from this Site at any time, and for any reason, without notice.

Amongst the services Sahesh offers, we offer the service of Cash Back, where you can take advantage of the service by collecting cash whenever you purchase one of the selected items in our list of stores included in our Cash Back offers. In addition to the Terms of this document, the Cash Back service is operated in accordance with, and governed by the following;

a. How it works:

1. You can take advantage of the Cash Back service whereby purchasing one or more of the selected items as listed in the list of stores included in our Cash Back offers as per the cash tap will earn you cash as per the Terms of the service below.
2. Upon availability, you must purchase such item through clicking on the “Start Shopping” icon in the App or Website to qualify for cash back.
3. Cash will show in your account after two (2) business days from the date in which you purchased the relevant item. Such cash will be in “Pending” status and under approval until validated and approved as per the below conditions.

b. Terms of the service:

1. You must have an active account on the Website.
2. Your email address must be valid.
3. You must agree to the Terms and Conditions and Privacy Policy of the Website.
4. You must complete a purchase of one item or more of the selected items as listed in the list of stores included in our Cash Back offers.
5. You must access the listing of the item through the “Start Shopping” icon in the App or Website.
6. You must complete your purchase during the same session and without disruption, as disrupting the process by visiting other websites or clicking through other links before completing your purchase might result in you not earning any Cash Back from such purchase.
7. Your purchase must go through without any return, replacement or refund on the purchased item from the store.
8. After fourteen (14) days of the day in which you purchased the item, provided that you did not request a refund for, replacement of or return the item from the store and that you met all the conditions as per these Terms and as per the terms in the cashback tap in the App, the cashback status in your account shall change to “Confirmed”.
9. When you collect enough cash, you may exchange your cashback with one or more of our Gift Cards (provided that your cash’ value meets the value of the Gift Card as per point 5 above). Cashback cannot be exchanged for cash.
10. The maximum limit for exchanging Gift Cards with cashback is 3 Gift Cards for every (24) hours.
11. Once you exchange cashback with Gift Cards, the Gift Cards may not be returned or exchanged.
12. Returning, replacing or refunding purchased items from the store will cause you to lose the cashback earned from such purchase due to not meeting the terms of the service.
13. Cash Back amounts may vary from one product to another and from one store to another. Please check the cashback tap for further information.
14. Some stores may not award cash back from purchases made through mobile applications. This may not always be the case, however, in such cases, please note that you may not receive cash back.
15. Using discount codes or coupons in a relevant purchase may result in losing the chance to earn Cash Back.
16. Cash Back amounts are based on the value of the relevant products, which does not include any additional costs or fees you might pay, such as but not limited to; VAT, shipping, extended warranty, gift wrapping.
17. Stores included in the Cash Back service may update/change their list products and/or the amount of Cash Back included in the list of stores of our Cash Back offers. We will do our best endeavors to constantly update and have all information in the Cash Back service up-to-date.
18. As the Cash Back service is intended for personal use, you’re allowed to operate and benefit from the Cash Back service in a maximum of one account. Should we discover that you manage more than one account, we shall have the full discretion to deactivate all of your accounts on the Website and retain any cashback you may have collected on such accounts.
19. Cashback may not be assigned to another account, whether such account belongs to you or a third party.
20. We recommend that you enable your cookies while using the Cash Back service to ensure that any cashback you earn from Cash Back gets associated with your account.
21. Illegal and fraudulent activities are not tolerated on the Website. If we discover any fraudulent or illegal activities in your account, we reserve the right to suspend your account and/or deactivate it, and retain any cashback you may have collected on such accounts under our full discretion and without prejudice to any other rights or remedies available at law.

Amongst the services Sahesh offers, we offer the service of Referral, where you can take advantage of the service by collecting cashback whenever a person registers and creates an account on Sahseh using your unique Referral code you send them, which will be created once you create your own account on Sahseh. In addition to the Terms of this document, the Referral service is operated in accordance with, and governed by the following;

a. How it works:

1. Upon your registration on the Website, a unique Referral code will be created for your account, comprised of letters and digits, which shall differentiate from other users on the Website.
2. You may invite your family members or friends by sharing with them your Referral code.
3. The recipient of your Referral code must register on the Website.
4. After the registration is complete and the requirements are fulfilled, you and the recipient will each receive Cash Back in your account (subjected to change).
5. Additionally, if the recipient, after completing the registration on the Website, purchases a product in accordance with the Cash Back service terms referred to in these Terms and Conditions, you and the recipient will each receive additional Cash Back in your accounts. This feature is subject to the terms of the Cash Back service, including but not limited to the terms related to the entitlement of the Cash Back.

b. Terms of the service:

1. You must have an active account.
2. You and the recipient of your Referral code must have a Saudi Arabian phone number.
3. This service is only available to residents of the Kingdom of Saudi Arabia.
4. Cash Back credit earned from this Referral service is valid for use for ninety (90) days from the date of when the Cash Back has been earned, not using it in such period will result in the expiry of Cash Back credit and you will not be able to use it thereafter.
5. You must agree to the Terms and Conditions and Privacy Policy of the Website.
6. We may at any time, revise, amend or add to the Referral Term of service as we see fit and to our absolute discretion, you should review these terms on a regular basis while utilizing the Referral service.
7. The referred users must be real user, not same person with different phone number.
8. Illegal and fraudulent activities are not tolerated on the Website. If we discover any fraudulent or illegal activities in your account, we reserve the right to suspend your and the recipient’s accounts and/or deactivate them, and retain any points which may have been collected on such accounts under our full discretion and without prejudice to any other rights or remedies available at law.
9. The availability, disablement or suspension of the Referral service is subject to our absolute discretion.

This Site is provided "as is," with all faults, and we make no express or implied representations or warranties, of any kind related to this Site or the materials contained on this Site. Additionally, nothing contained on this Site shall be construed as providing consult or advice to you.

In no event shall we, nor any of our officers, directors and employees, be liable to you for anything arising out of or in any way connected with your use of this Site, whether such liability is under contract, tort or otherwise, and we, including our officers, directors and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Site.

a. By accessing the Site, you hereby indemnify us to the fullest extent from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to your use of the Site.

b. By accessing the Site and using it, you hereby warrant that all information and data entered and registered by on the Site is correct, and that you are the lawful owner of such information and data, and you agree to indemnify us and hold us harmless against any third party. In the event where we identify that such information or data entered by you is incorrect, we shall have the right to suspend your account and all transactions on the Site, and prosecute you legally for any damages that result or may result from such act.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

We may at any time, revise these Terms as we see fit, and by using this Site you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing use of this Site. You will be notified via email for any modifications of these Terms.

We shall be permitted to assign, transfer, and subcontract our rights and/or obligations under these Terms without any notification or consent required. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

a. These Terms, including any legal notices and disclaimers contained on this Site, constitute the entire agreement between you and us in relation to your use of this Site, and supersede all prior agreements and understandings with respect to the same.

b. The Site’s policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, you are encouraged to frequently visit these sections in order to be updated about the changes on the Site. Modifications will be effective once such modifications are posted.

a. These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia.

b. Any dispute or claim arising out of or in connection with this Site shall be resolved amicably, in case an amicable solution cannot be reached, such dispute shall be referred to the exclusive jurisdiction of the courts in the Kingdom of Saudi Arabia.
